Terms And Conditions

I acknowledge and agree to all the following Terms & Conditions regarding my enrolment,
participation, and graduation in the Professional Year Program (PY), (“The Course”) with
Performance Education (PE). I understand that any variation to these Terms & Conditions must
be in writing with 28 days’ notice and signed on behalf of PE by an authorised representative.

1. General

1.1 The duration is expected to be *atleast 12 months and includes ACS online orientation, face to face coursework,
e-Learning, pre-internship period, Professional Environments course hosted by ACS, and a 12-week unpaid
internship placement. All components must be completed successfully and all fees paid before graduation
from the course can occur. Please note that students must be onshore during the entire course including
pre-internship period, eLearning, face to face classes, internship and graduation.

*Whilst the expected duration is *atleast 12 months, this timeframe may be extended due to circumstances such as
any emergency leave/deferral undertaken, delays in marking of assessments or completion of ACS Professional
Environments, delays in the student completing their coursework components, delays in internship placement
start dates or completion dates, closure of host companies/Performance Education/ACS during any holiday period
or Christmas/New Year closure period, and any other unforeseen events. Whilst Performance Education will take
steps to minimise any delays, Performance Education cannot be held responsible for any extensions to the
overall course duration.

1.2 Successful completion of the Professional Year Program does not guarantee that a
student will receive permanent residency in Australia.
1.3 Participation in the pre-enrolment interview and completion of the pre-enrolment
checklist is compulsory before receiving confirmation of enrolment to The Course.
This interview will be recorded, and your consent is required to proceed with the
enrolment process.
1.4 Students must be onshore for the duration of The Course, including pre-enrolment,
face-to face learning, assessment submission, eLearning, internship, and graduation.
Upon commencing The Course and throughout The Course, students agree to have
PE complete VEVO Visa checks to confirm student location while undertaking The
Course.
1.5 From time to time PE runs special offers, discounts or scholarships. These must be
applied for prior to enrolling and commencing the program and have special terms
and conditions that must be adhered to in addition to these PY Terms and
Conditions. These specials cannot be applied for after the promotional dates or after
commencing the PY program. In signing these Terms and Conditions, you agree to
not hold PE liable for any issues regarding the special offers, discounts or
scholarships offered at the time, including any discussions or interactions with a
migration agent around course enrolment. Any student not provided with suitable
information regarding special offers, discounts or scholarships by their agent must
address these issues with their agent. PE is not liable for any lack of information
provided by agents regarding these specials offers, discounts or scholarships.
Student are unable to claim these special offers, discounts or scholarships during
the course of their PY studies or in retrospect.
1.6 No element of the PY program may be fast-tracked or expedited due to a change in
student circumstances or visa restrictions.

2. Visa and Passport validity requirements

2.1 All acceptable Visas must have full work rights (no restrictions) and full study rights
(no restrictions) as part of eligibility requirements to enrol, study, complete, and
graduate from The Course. Visa changes may affect a student’s ability to meet this
requirement. If this occurs, withdrawal from The Course with full tuition fee
payment/no refund will still be required.
2.2 Students must hold a valid Passport for the duration of The Course, including preenrolment and graduation.
2.3 Students must advise PE in writing of any changes to their Visa and Passport details
including, visa status, visa applications, visa approval, new passport, and change of
contact details, within 14 days of such change.
2.4 The student is wholly responsible for all matters concerning their visa and will not
hold PE liable for any matters relating to this.

3. Attendance and Course completion

3.1 Attendance required is 100% throughout all components of The Course, in
accordance with the requirements of governing bodies ACS (IT) and Department of
Home Affairs (DHA). Any class or internship absence due to illness or exceptional
circumstances must be supported by a valid medical certificate or meet criteria for
exceptional circumstances as outlined in the
“Compassionate and Compelling Circumstances Policy and Procedure” available on
the student portal. Medical certificates will only be accepted if coming from a
registered medical practitioner and the provider must be registered and searchable
using the “Look up a Practitioner” tool available on https://www.ahpra.gov.au/.
Medical certificates from an online site are subsequent to further conditions and PE
reserves the right to refuse those that do not meet requirements. Students should be
aware that any evidence provided in support of missed attendances may be
confidentially verified by PE,to confirm its authenticity. Further details on these
requirements can be found in the “Compassionate and Compelling Circumstances
Policy and Procedure”, the “Leave/Deferral Policy and Procedure” and referenced in
related attendance policies available on the student portal.
3.2 Failure to achieve attendance requirements is an automatic failure of The Course.
3.3 If a National Public Holiday falls on a student’s study day, the student will be required
to attend another class during the week to ensure continuity of learning. Students
will be advised in advance of arrangements for National Public Holidays. PE will
work with students to organise a suitable class day in the week that meets students’
needs, however this is due to class capacity availability and therefore cannot be
guaranteed.

3.4 Should failure of the PY course occur due to lack of required attendance, or any
otherreason, no refund is due. See also Section 9. “Fees, Payments and Refunds”,
for further information regarding refunds.
3.5 Pertaining to absence due to illness or compassionate/compelling circumstances
referenced in Section 3.1, must be supported with appropriate and valid evidence
and approved by PE. If the absence is not legitimate, lacks relevant supporting
evidence, or is not exceptional, students will be required to re-enrol in the subject or
internship. If the absence is legitimate and supported with evidence, students may
be invited to take a make-up class to achieve the required attendance. This is at the
discretion of PE after reviewing all evidence and facts presented by the student.
Fees may apply in any of these instances due to administration and course
rescheduling. See Section 10 “Additional Fees” for further details.
3.6 A subject failure will automatically be applied if more than one class is missed per
subject. Subject failures will require students to reschedule their course and will lead
to delays in graduation dates. Should your attendance fall below the requirement you
will need to re-enrol in the subject/s to meet these requirements. Your original
attendance for that subject will not count towards the attendance of the re-enrolled
subject.
3.7 100% attendance is required for Internship; thus, any legitimate absence will need to
be made up. This will be at a time that suits the Host Company and the student, with
notification made to PE immediately.
3.8 It is compulsory to attend the first class of The Course. If a student does not attend
the first class, they or their agent will be contacted by PE and the student will be
withdrawn and required to be re-enrolled in anotherintake. ALL fees will still be
payable and no refund of fees already paid will be provided. Section 9.11 will provide
further details. IT students will also incur ACS deferral processing fees as indicated
in Table 10.3. Should the student remain uncontactable or does not attend
subsequent classes, the student will be withdrawn. In all cases, full fees are payable
from the initial intake date. If a student wishes to withdraw, they must contact
Student Services py@performance.edu.au and lodge a formal withdrawal. A written
email, a phone call or ignoring contact entirely is not a formal process for withdrawal
by the student. Section 9 “Fees, Payments and Refunds” will detail the payments
required for withdrawal.
3.9 Graduation dates are only tentative and non-binding. Changes to graduation dates
may occur for various reason, including, but not limited to; subject or course failures,
leave/deferral under exceptional circumstances, public holiday closures or holiday
shut down periods, Professional Body closure periods or extended marking periods,
unavoidable or unprecedented events beyond the control of PE. PE will only provide
Graduation from The Course when the student meets all of the following criteria:
• All PE assessments are competent/passed.
• All attendance requirements are met in full.
• All fees and additional fees are paid in full, with no outstanding debts.
• Relevant Visa and Passport are still valid.
• IT students ONLY: Successful completion of ACS Professional Environments
online with Competent rating.
3.10 Course re-enrolment after withdrawal may be undertaken if the student was not
initially withdrawn due to misconduct, behaviour contrary to the Student Code of
Conduct, complicit with unlawful actions or activities, or identified as not able to
re-enrol due to visa restrictions. If there is a gap of one year or more between
withdrawal and re-enrolment, or there have been changes to any part of the
Professional Year program since withdrawal, the student must recommence and
complete the entirety of the program from the beginning.

4. Assessment completion requirements

4.1 Assessments are conducted in a variety of ways, including, but not limited to: in
class, online, and eLearning. It is expected that all assessments are completed on
time. A minimum pass grade is required for each assessment. Students who do not
meet this pass grade are allowed another attempt at the assessment. Students are
required to be present for in-class assessments. Any absence will require either a
Re-Assessment Workshop or class rescheduling. See Section 4.2 and 4.3 for further
details.
4.2 Late Assessments will not be marked unless exceptional circumstances exist and
are approved by PE. Late assessments that are unmarked, or assessments that do
not achieve a pass grade after Trainer/Assessor assistance and feedback, will
need to be completed via a Re-Assessment workshop (RAW). A key pre-requisite of
the workshop is that attendance requirements for the subject and course have
been met. This attracts additional fees as detailed in Section 10. “Additional Fees”.
4.3 Any assessments that are not submitted will be marked Not Yet Satisfactory (NYS)
and the subject will be marked as Not Yet Competent (NYC). If attendance has been
met, students will be invited to a RAW for assessment completion. If attendance has
not been met, students will need to undertake the subject again. Fees will be
charged in both instances as per Section 10. “Additional Fees”. Make-up classes for
missed assessments and/or missed attendance are dependent on individual
student circumstances and are at the discretion of PE. RAWs and MUC fees are to
be booked and paid in advance.
4.4 PE is determined to protect the integrity of its program and its quality reputation;
therefore, plagiarism, collusion or cheating will not be tolerated. Students caught
plagiarising, colluding, or cheating will:
● Be given an NYS result for that assessment
● Be required to reattemptthe assessment
● Potentially have their course progress disrupted and graduation delayed
● Be charged an Additional Service Fee for each assessment that needs to be reassessed.
4.5 Continued cheating, collusion or plagiarism could result in significant delays in
graduation or withdrwal from the PYP program.

5. Leave and Course Deferrals

For the purposes of this section “leave” refers to a short leave of absence from The Course
for any period of less than 4 weeks. Absence from The Course which requires the
rescheduling of more than one subject is referred to as “deferrals”. No more than 6 months
deferral can be applied for in total and is dependent on the student’s ability to complete
The Course before their Visa expires. See Section 2 for visa requirements that apply to the
PY program for all students. Deferrals refer ONLY to deferral of The Course subjects and/or
internship and do not apply to payment deferrals. Student course fees, payment plans, and
leave/deferral fees must be paid as scheduled regardless of leave/deferral taken.
5.1 The Course structure provides for break period across both Easter and
Christmas/New Year periods. Students should utilise this time to make
arrangements for any leave or travel as applications for leave during the program
times may not be granted. Leave applications at any point during the program will
only be granted in cases of emergency and at the discretion of PE and the
Professional Bodies of The Course (ACS for IT). An application for leave/deferral
must be made using the correct forms and have supporting evidence attached
regardless of the length of time applied forto py@performance.edu.au. Incomplete
forms, lack of evidence or incorrect forms used will be deemed an automatic
rejection of leave/deferral. See 5.3 for further details. Any type of leave/deferral
may lead to a delay in graduation and extension of the course length. You must
have a valid and acceptable visa that covers the extended length of The Course.
Overseas travel arrangements during this exceptional leave must be provided in the
form of a return flight ticket confirmation. If a return flight ticket cannot be provided,
the Professional Body will expect that the student is withdrawn from the course and
will have to re-enrol, and pay all related re-enrolment fees in full.
5.2 Any leave/deferral that results in a student not being able to complete The Course
due to Visa expiry will be denied. PE will always provide a reason why leave/deferral
was denied. Should a student wish to appeal this, they may do so in accordance with
the Complaints/Appeals Policy and Procedure available on the student learning
management system.
5.3 Leave must be applied for using the correct forms. A written email is insufficient
when applying for leave/deferral. IT students require two forms: PE Leave Form and
ACS Transfer Form. A $200.00 Leave Processing Fee may be charged for Leave (up
to 4 weeks) that results in a course schedule change and/or extension of graduation
date and/or if it effects on-time placements.
5.4 A $400.00 fee may be charged where a leave application is submitted less than 7
days priorto the leave commencement date or priorto the student’s next subject
start date. A $150.00 Deferral Processing Fee may be charged for Deferral that
results in a course schedule change and/or an extension of the graduation date.
5.5 Any student found to have taken leave without following the above leave procedure
including when a leave application has been submitted but is awaiting approval will
be in breach of The Course Terms and Conditions. This may lead to withdrawal of
the student from The Course. All fees remain payable if withdrawal occurs. Should
PE allow the student to continue The Course, a $500.00 fee to cover course
rescheduling and additional administration will be charged and payable immediately
before re-commencement of The Course.
5.6 Leave or deferral cannot be taken during the 2-week Pre-internship Period unless
approved under exceptional or compassionate circumstances as outlined in the
“Compassionate and Compelling Circumstances Policy and Procedure” available on
the student portal.

6. eLearning and online coursework

6.1 Some subjects have an eLearning component. Attendance for the entire day is
mandatory as per a normal PY study day. Students must complete the full day’s
learning to have any attendance registered. Any full or partial absence for
the eLearning day will be treated as per the process identified in Section 3
“Attendance and Course completion”.
6.2 The eLearning component is considered an assessment of the PY unit and subject.
A satisfactory grade awarded to the eLearning component is based on the following
conditions:
• The eLearning component of the PY Unit must be successfully completed on the
student’s scheduled study day within the week allocated for the eLearning
component to take place.
• The full range of activities set out within the eLearning component must be
successfully completed in full.
• Time stamp monitoring must indicate full attendance forthe day of the eLearning
component.
6.3 A Trainer/Assessor will be available to support students throughout the
eLearning day via messenger, phone or Zoom video conferencing.
6.4 Students will be coached and supported regarding eLearning expectations by their
Trainer/Assessor in the week prior to the eLearning unit. Attendance and
participation are expected on this day. If a student fails to complete their eLearning
on their designated day of study, they may be required to attend a face to face make
up to ensure their attendance is met.
6.5 Failure to complete all requirements on a student’s scheduled study day will result in
a Not Yet Satisfactory (NYS) grade with any outstanding requirements needing to be
completed as part of a Re-Assessment Workshop (RAW). A RAW attracts fees as per
Section 10 “Additional Fees”.
6.6 Study environment requirements and conditions are to be met by the student and is
the responsibility of the student. PE takes no liability for any injury, issues or damage
that may occur during a student’s eLearning unit.
6.7 All eLearning and assessment completions should be undertaken while onshore
and, in the state, orterritory your enrolled PY course is undertaken. All online
assessments must be submitted while onshore. PE completes compliance checks
using geolocations and VEVO online visa checks regularly to check student
locations. Any students found to be offshore while participating in any part of The
Course risks being withdrawn from The Course with no refund. All outstanding
tuition fees will still be required to be paid.

6.8 It is the student’s responsibility to read the Academic Progression Policy available on
Moodle, ask any questions in relation to expectations and completions with their
Trainer/Assessor.

7. Internship

Prior to commencing internship, all outstanding fees must be paid in full. Unpaid fees will
compromise the commencement of internship, causing delayed internship and graduation
until outstanding payments are made in full. PE is NOT required to provide Regional
Internships for any students living in Regional areas or re-locating to Regional Areas during
the course of their PY studies.
7.1 All students are required to attend organised activities as part of The Course,
including the internship placement. This includes attendance at the Internship
Presentation which is generally conducted after week 8. This is a compulsory
meeting outside of your allocated class attendance times which assists you in
understanding the internship process and requirements, expectations and policy
requirements. Students must be available from approximately 10 weeks prior to the
internship placement to meet with a placement consultant and begin the internship
placement process. Students not available for the internship placement process will
incur rescheduling fees payable to PE and ACS (IT students only) and their internship
will be moved to a later cohort. See Section “10 Additional Fees”.
7.2 During the internship, PE and the Host Company may need to obtain medical
treatment for a student should PE (and the Host Company/Companies), deem such
action necessary. By attending the internship, the student agrees to indemnify PE or
any Host Companies for any expenses, loss, damage, or liability whatsoever
occasioned due to authorising and arranging any emergency medical treatment
required for the student.
7.3 PE will arrange an internship placement relevant to the student’s field of study, IT.
Whilst PE will consider the student’s preferences, the internship will also be
dependent upon availability and suitability of the student forthe role. Students will
need to attend interviews forthese placements, sometimes at short notice. Students
must make themselves available during the entire pre-internship period and
internship process to attend these necessary events. Host Companies will be
selected at the discretion of PE; and that an offer of an internship placement is at
the discretion of the Host Company. Students may be required to travel up to 2
hours or within 200km each way from their home to attend internship placement, as
per requirements from our Professional Bodies. Students who do not make
themselves available for interviews and continue to refuse interviews may be
charged a Non-conformance fee. See table 10.1 for further details.
7.4 100% attendance is required throughout the internship placement period and to
complete any work assigned. Any sick days must be made up by attending
additional days. Days are subject to host company discretion. Internship is not
complete until time is made up in full.
7.5 To successfully pass the internship placement students must adhere to the
conditions set out in the Training Agreement, including but not limited to successful
completion of the internship placement, appropriate attendance of and performance
during the internship placement. If a student fails the internship placement, another
internship is provided at the discretion of PE. The student will be liable for additional
fees for a replacement internship placement. See Section 10 “Additional Fees”.
7.6 Self-sourced (Own Employment Placement) internships are only accepted for paid
employment in the related field to your IT PY Program. Substantial evidence of
employment will need to be provided by the student and the company will need to
be vetted and approved by PE to ensure the internship is suitable in accordance
with Professional Body requirements. An Own Employment placement is not
confirmed until all necessary checks and approvals have taken place. During your
program you will receive more information on deadlines for required evidence
submission.
7.7 Non-local placements are considered any placement located more than 200km/more
2 hours travel from a student’s home but within the same state as the PY campus
attended.It is a preference that this is the student’s own paid employment, howeverif
PE has a placement opportunity that is in a non-local area, a student may be
permitted to attend this placement if the student agrees to the travel distance.
7.8 Interstate internship can only be considered if it is a paid employment position and
thus will require the same evidence and vetting as a local own employment
placement.
7.9 For Own Employment Non-local or Interstate placements, PE must conduct checks
to ensure the proposed host company meets the conditions required. Should there
need to be non-local distance travel by a PE consultant to undertake these checks,
travel and accommodation costs incurred by PE will be recoverable by PE from the
student. Where possible PE will keep these costs to a minimum. Further details can
be found in the “Own Employment Internships Policy and Procedure” available on the
Moodle platform.
7.10 For Skilled Migration Assessments, internship during the Professional Year Program
does not meet the “Professional Level” requirements. Specifically, one-year paid
employment must meet the “Professional Level” requirement. PE cannot provide
guidance on how to meet these requirements. For further guidance ACS are able to
address your specific queries or case.
7.11 Failure of your internship due to the provision of misleading information, fraudulent
activity or concerns around the integrity of the internship, may result in removal from
the Professional Year Program with no re-enrolment permitted. In these instances,
removal from the program and/or re-enrolment into the program will be decided by
the respective Professional Body and enforced by Performance Education. Should
re-enrolment be permitted, fees will apply, as per Section 10 of this document.
7.12 Students may be given the opportunity to provide host company leads for internship
placement, however,this information MUST be received priorto the Pre-placement
Interview. Documents and details required by Performance Education and the
related Professional Body will be disclosed at the Internship Presentation session.
Performance Education and/or the related Professional Body may refuse/decline a
host company referred as a student lead if internship requirements are not met or
concerns have been identified.

  • Professional Year students, their agents and internship supervisors attest that all information and documentation provided as part of their PY Program is true and correct and that they have not, and will not, provide information or documentation that is false or misleading, which is in breach of the Criminal Code Act 1995 (Cth), the Migration Act 1958 (Cth) and PIC 4020. If the Professional Bodies credibly suspect misrepresentation or fraud, the Professional Bodies have the right to:
  • Deem an internship and its nominated ANZSCO occupation unsuitable,
  • Ban the applicant from future migration skills assessments or memberships,
  • Officially report the matter to the Department of Home Affairs for further action, and/or
  • Inform other relevant government authorities to maintain assessment and migration process

Knowledge of any suspected fraudulent activity must be reported to PE and the Professional Bodies immediately for follow up.

8. Bring Your Own Device (BYOD) and computer requirements

8.1 Students are required to bring a fully charged compatible device to specified classes
in accordance with PE’s BYOD policy and have access to suitable computer and
internet capacity/speed to undertake eLearning and online components of The
Course.
8.2 Students must follow trainers’ directions as to appropriate use of their devices in
classes.
8.3 Each student is solely responsible for the care, maintenance, and use of their own
device. PE will not be liable for any damage, issues, viruses, or security of student’s
own devices.

  • 9. Fees, Payments and Refunds

For fees, payments, and refunds “commencement”, ”commencing” and/or “intake date” of
The Course refers to the Monday of the intake week and not the student’s study day of the
week. When referencing “working days” these are considered as a normal working week of
Monday to Friday. Upfront payments and first instalments are due at time of enrolment.
See Table 9.11 and Table 9.12.
9.1 The Administration Fee is $150. This fee must be paid in full to secure a position in
any intake. The Administration Fee is not refundable under any circumstances.
9.2 Students will not be permitted to commence or continue their course until all
outstanding fees have been paid. This may include removal from classes, delayed
internship placement and delayed graduation.
9.3 All fees are payable in Australian Dollars (AUD) and will be automatically charged to
the nominated account (credit card or bank account) that is held on file for
payments.
Instalment Payments
9.4 Payment of fees by instalments is only available upon completion of the Deferred
Payment Plan Direct Debit Authority form (fees and charges apply, check the DDA
form)
9.5 The first instalment of tuition fees on an instalment plan is due at time of enrolment
to the Course.
9.6 Subsequent instalments will be deducted every four weeks from the
commencement of The Course regardless of any leave/deferral taken during The
Course.
9.7 In the case that any scheduled payments are dishonoured, for any reason, a $50
administration fee will be incurred by the student per occasion.

  • 9.8 A $50 Administration Fee may be charged for any manual processing of payments
    that are processed outside of the direct debit arrangement.
  • 9.9 Any change to the instalment plan schedule requires 7 working days written notice.
    9.10 Full Refund
    PE agrees to refund to the original fee-paying party all tuition fees paid upon receipt
    of written notice of cancellation from the applicant in the following circumstances:
    • Where PE is unable to offer The Course; or
    • Where PE refuses the application for enrolment.

 

9.11 Cancellation/Withdrawal Refund Policy: Upfront Payment

For students who have made a full upfront payment, PE agrees to refund part of thetuition fees paid, to the original fee-paying party, upon receipt of written cancellation from the applicant in accordance with the below table and terms.

9.12 Cancellation / Withdrawal Refund Policy: Monthly Instalments

For students who have elected to pay by instalments, PE agrees to credit theirtuition
fee balance, upon written notice of cancellation by the applicant as per below table
conditions only. Any balance of tuition fees due and payable, together with any
outstanding administration fees must be paid immediately upon the acceptance of
the applicant’s withdrawal.
The balance of tuition fees due will be determined by the timing of the receipt of the
written notice from the applicant, as shown below:

9.13 If a student is deferred to the next intake for any reason, for the purposes of
withdrawal the initial intake date is used to calculate the notice period. The initial
intake date will always be the Monday of the intake week the student first applied for.
9.14 Students are responsible for attending to any communications received from the
finance team in relation to their fees and outstanding debts. Any delinquent debts
may be escalated to a debt collection agency if no payment arrangements have been
made and debt is older than 45 days outstanding. Students may be liable for debt
collection fees, additional charges and bank charges incurred in the process of
recovering fees. PE holds no liability on how this may affect your future credit rating.
9.15 Should Gradability be unable to provide the student with an interview at any host
company within 3 months of the student’s intake start date despite the student
engaging in all other program related activities, a full refund LESS $500 cancellation
fee plus any non-refundable Agent Fees (where applicable) will be provided. In this
instance the student will be withdrawn from the program entirely.

10. Additional fees

10.1 Additional fees and charges apply to all students, in accordance with the “Additional
Fees” Table 10.1 below. These include:
• Change of study day, whether it involves changing subject streams and/or changes
from weekday to weekend and vice versa.
• Re-enrolment due to subject failure; Course Re-enrolment.

10.2 IT STUDENTS: Where applicable, as a Professional Year IT student, the Australian
Computer Society will apply additional fees in the following cases.
• Failure of the ACS online module and must be re-enrolled ($900 + GST)
• Transferto another ACS online cohort due to leave or deferral ($115 + GST).
PE reserves the right to charge these fees and pass them to ACS.
If a student enrolled in the ACS Professional Year(Information Technology) fails,the
PE On-line component any additional charges made by ACS for re-enrolment will be
incurred by the student.
10.3 Additional administration fees – IT students only
PE delivers the Professional Year IT on behalf of the Australian Computer Society
(ACS). As ACS provides further study and training associated with their PY course
(Professional Environments Online) some student actions and activities also affect
this program and therefore attract certain ACS fees. These fees are in addition to
those charged by PE. PE collects these fees on behalf of ACS and forwards them,
once paid by the student, to ACS. In some cases when students are late in providing
correct information and forms to ACS, PE incurs a fine. On these occasions where
the student imparts negligence, PE will also charge additional fees to the student’s
account to cover administration and resource costs.

Once you have commenced your Professional Environments Online ACS course
component any application for transfer or deferral will incur additional fees from the
ACS.

11. Student conduct

11.1 Any student behaviour that is deemed unacceptable by PE, including but not limited
to, not following the Student Code of Conduct, acts of plagiarism, unprofessional
behaviour, or harassment, may result in withdrawal from the course with no refund of
course fees or any additional fees incurred. Any outstanding debt is to be paid
regardless of withdrawal.
11.2 Students should be conducting themselves professionally at all times, including
when attending interviews at host companies. During interviews, students must
communicate and respond effectively with the host company representatives,
presenting their skills and knowledge in accordance with their resume and
showcasing themselves in a professional manner. PE provides coaching and
support to students in order to secure an internship successfully. Any deliberate or
wilful non-professional performance during these interviews may jeopardise the
completion of the PY program. Should this occur and the student has been
presented to suitable opportunities with continued failure to secure internship, PE
may defer, withdraw the student from the cohort or impose an Internship nonconformance fee to cover continued time and work completed by the Internship
team.
11.3 From time-to-time PE sends emails to students regarding important PY course
information, internship information, course reminders, notifications of events, special
offers, meeting requests etc. Students are expected to read all communication from
PE and action all requests. PE takes no liability if the student’s course, internship or
successful course completion is hindered by students not reading and/or
responding to emails sent directly to the email address students provided to PE.
11.4 A PY student experiencing stress which is impacting their mental well-being andability to study should reach out to PY staff for assistance or access PY support services and/or a list of resources found in the Mental Health Kit available to students on the Student Learning Management System

document and in the below information. I will commit to attending 100% of The Course, and will attend 100% of the internship placement
component of The Course. I understand that the Professional Year is a program designed to enhance my employability and improve my
communication skills as well as understanding of the Australian workplace.
▪ I acknowledge and agree that I have been provided information on course start date, location, attendance times, fees, refunds, mode of delivery,
expectations, internships, and entry requirements prior to enrolment in The Course.
▪ I declare that the information I have supplied in this application is, to the best of my understanding and belief, complete and correct.
▪ I understand that the giving of false or incomplete information may result in the refusal of my application or cancellation of enrolment.
▪ I acknowledge that I have been given sufficient information about the course and have read and understood all available information in
brochures, policy, and procedures, and on Performance Education’s website at www.performance.edu.au.
▪ I give Performance Education permission to obtain official records from an educational institution attended by me. I understand that
Performance Education collects, stores, and uses personal information only for the purposes of administering prospective, current, and
graduate student admissions, enrolment, and education and that the information collected is confidential and will not be disclosed to third
parties without my consent, except to staff of Guru Group Holdings and Associated Entities , Professional Bodies, Department of Home Affairs,
Australian Government Bodies. This includes accessing and checking student visa details on VEVO at any time from pre-enrolment through to
graduation.
▪ Per the Department of Home Affairs requirements, the Professional Year Program has been designed to develop student’s work-readiness skills
in a face-to-face learning environment. To protect the health and safety of students and staff, the program may transition to temporary online
delivery as advised by the education provider and approved by ACS. I will be directed to return to (or remain in) the classroom to fulfil DHA’s PY
Program requirements when deemed safe to do so. This may occur at any time throughout my PY Program journey. My education provider
commits to providing communication and local resources to support my program experience.
Therefore, as a PY applicant, I acknowledge and understand that I must:
a. Remain on shore in Australia during active program delivery (e.g., in-class, online, and work-based learning/internship );
b. Remain in the state that I enrolled;
c. Remain within a reasonable distance of my delivery campus to complete classroom and internship requirements; and
d. Notify my education provider if I intend to move and/or change my address for any reason.
▪ I understand that if I have applied through an approved Performance Education agent, all correspondence relating to my application will be
forwarded to that agent.
▪ I understand that course fees and additional fees may increase. I accept liability for payment of all fees as explained in the brochure and Terms

absence, or would have run but for my absence.

understanding of the Australian workplace. I agree to the attendance requirements of the course and the terms and conditions of the course.

✔ I understand that should I breach any of these terms and conditions of the PY Program, withdrawal from the program may result and full
payment of fees is still expected. Should I wish to re-enrol into the program I will be liable for all additional re-enrolment fees and may have to
complete the entire PY program again, particularly if a new curriculum is implemented, requirements have changed or a gap of 1 year or more
has lapsed between my last attendance prior to withdrawal and re-enrolment into the PY Program. Re-enrolment is subject to approval by PE
and/or the related Professional Body.
